As some may know, the HCBS settings rule went into effect March 17, 2023; some states have had their statewide transition plans approved and some states are still pending approval.

To learn more about the importance of the HCBS settings rule, please see: HCBS Settings Rule | ACL Administration for Community Living

To follow all states’ compliance with the HCBS settings rule and to follow Texas’ progress on this rule, please see:  https://www.medicaid.gov/medicaid/home-community-based-services/statewide-transition-plans/index.html

To have your voice heard on programs seeking approval of the HCBS settings rule, please consider providing public comment on these programs.  Currently, there is a program  in the state of Texas called 29 Acres which recently submitted a Heightened Scrutiny request to seek approval of the HCS settings rule.

Texas HHSC posted a summary of their Heightened Scrutiny review of the 29 Acres program. They are seeking public comment on their assessment, findings, and remediation activities for 29 Acres.

We encourage families, self-advocates and community partners to review and please submit your comments by the deadline of April 13, 2023:  https://www.hhs.texas.gov/sites/default/files/documents/heightened-scrutiny-setting-29-acres.pdf
